Do these properties have houses?
No. This is not a list of foreclosed homes. Surplus property may or may not have a structure. Bidder must use due diligence in checking the property's circumstances.
What is the purchase price of the properties?
The minimum bid price is listed next to the property on the list.
How do you purchase any of the listed properties?
Anyone interested would place an initial five percent (5%) bid deposit of the minimum bid amount to start the bid process.
Note: If the minimum bid is less than $1,000, the bid deposit will need to be the entire amount to start the bid process.
Can the property be purchased for a lower price?
No. Purchase offers cannot be lower than the minimum bid amount.
Can I get my bid deposit money back?
It is possible your bid deposit could be refunded, less the advertising fee if it has been advertised.
How often is the surplus list updated?
The surplus list is updated when property is added or sold.
Are the tax values correct?
The values are listed from the most recent Cumberland County Tax Revaluation.
What type of payments are accepted and who are they payable to?
Money order or certified bank check only, and payable to the County of Cumberland or Cumberland County. We do not accept cash.
Can I set up a payment plan when the balance is due?
No. Full payment is due at the end of the process. We do not accept installment payments.
What happens if someone outbids me?
You will be contacted if your bid is upset during the process. You have the choice to either: 1) Outbid their offer by 10% of the first thousand minimum bid amount (which is $100) plus 5% of the remaining minimum bid amount. 2) You can request to opt out and receive a refund, minus the advertising fees if the property was advertised during the outbid period. When the 10-day deadline to bid has closed, our office will submit a refund request for your surplus bid deposit.
Are there any other fees or costs?
Yes. There is an advertising fee that is added to the final cost and a Register of Deeds recording fee of $26.00.
How long does this process take?
There is not a specific time frame from start to finish; it could take up to 12 weeks or more. See the Surplus Property Bid Process tab to find out about the bid process.
How do I find out if these properties have liens?
The County Attorney's office staff cannot advise nor assist on any purchases. It is your responsibility as the bidder to determine the status of the properties, as they are sold as is subject to any liens, judgments, easements, and other matters of record. We strongly suggest that a title search be performed for any property prior to submitting a bid.
Can you refer me to an attorney who performs title searches?
No. We do not have a referral list of attorneys and the County Attorney staff cannot refer you to an attorney. We suggest doing a general search for a real estate attorney.
