DWI Court

DWI Court contains two very separate and distinct components.  First, a pretrial monitoring program and second, a DWI court treatment program for convicted Agg L1, level 1 and level 2 DWI defendants or at the discretion of the District Court Judge.

 

PRETRIAL MONITORING

ELIGIBILITY
Participants must:
• Be a resident of Cumberland County
• Receive an additional DWI charge while awaiting trial on a pending DWI charge.
• Receive a new DWI charge and have a DWI conviction within the past seven years.
• Receive a new DWI charge and have two DWI convictions ever.

REFERRAL/ENTRY PROCESS
Candidates are referred by the Magistrate who sets bond for a defendant at the time of arrest on the new charge of Driving While Subjecting to an Impairing Substance (DWI)

Pretrial Monitoring Responsibilities (required of participants until pending charges are disposed):
• Attend court sessions every other Wednesday at 2:00 pm in Courtroom 2B.
• Wear a continuous alcohol monitoring bracelet.
• Report for random drug screens
• Abide by curfew if applicable by Probation Officer
 

DWICOURT TREATMENT PROGRAM

ELIGIBILITY

Participants must be:

  • Resident of Cumberland County
  • A resident of a suitable household or willing to reside in transitional housing.
  • Convicted of Agg level 1, Level 1 or Level 2 DWI and in probation violation status

REFERRAL/ENTRY PROCESS

Candidates are referred by a probation officer currently supervising a defendant convicted of DWI in probation violation status.

Treatment Court Participant Responsibilities

  • Attend court sessions every other Wednesday at 2:00 pm in Court Room 2B.
  • Attend substance abuse treatment as needed per Treatment Provider
  • Attend one community support meetings a week or SMART Recovery Meeting
  • Submit to random drug testing.
  • Abide by 7:00 pm curfew in phase 1, 9:00 pm in phase 2, 10:00 pm in phase 3
  • Submit to random searches of home.
  • Suspend all fees while in the program.
  • Attend other classes as assigned (Anger Mgmt, Stress Mgmt, Money Mgmt, etc.), if applicable by Probation officer
  • Attend Cognitive Behavioral Intervention Course (12 weeks once or twice a week), if applicable by CBI Instructor and Probation Officer
  • Wear GPS monitoring unit/home alcohol monitoring system for a minimum of 60 Days
